EOS Companion Terms of Service

1. Acceptance of terms

By creating an account, signing in, or otherwise using EOS Companion, you agree to be bound by these Terms of Service. Account creation constitutes acceptance. If you do not agree, do not use the app.

2. Eligibility

EOS Companion is intended for authorised users of an EOS tenant workspace. To use the app you must:

• Be an authorised user provisioned by the tenant administrator of an EOS workspace, and
• Be 18 years of age or older, or otherwise be using the app on behalf of a business in the course of that business's operations.

3. License grant

Subject to your continuing compliance with these Terms, XenithPulse Software grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the EOS Companion mobile app on devices you own or control, solely to access the EOS workspace you are authorised to use.

4. Acceptable use

You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the app, except where this restriction is prohibited by applicable law.
• Use any automated tool, scraper, bot, or script to access the app or its backend services.
• Share your account credentials with any other person, or permit any other person to use your account.
• Use the app to violate any applicable law or regulation, or to infringe any third-party right.
• Interfere with, disrupt, or attempt to gain unauthorised access to the app, the EOS backend, or any associated systems or networks.

5. Account responsibilities

You are responsible for keeping your username and password confidential and for all activity that occurs under your account. You must notify XenithPulse promptly at admin@xenithpulse.com if you become aware of any unauthorised use of your account or any other suspected security incident.

6. Service availability

EOS Companion is provided "as is" and "as available". The free companion app does not carry a service level agreement (SLA). We may perform planned maintenance, deploy updates, and adjust features at any time. Continuous availability is not guaranteed.

7. Termination

You may terminate your account at any time by following the process at /account-deletion. XenithPulse Software may suspend or terminate your access for breach of these Terms, abuse of the service, security risk, or where required by law. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will continue to apply.

8. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, EOS Companion is provided without warranties of any kind, whether express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, the total aggregate liability of XenithPulse Software arising out of or related to these Terms or your use of the app is limited to the amount you have paid XenithPulse Software for the app in the twelve (12) months preceding the event giving rise to the liability. As EOS Companion is provided free of charge, this amount is USD 0.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited. Without prejudice to any mandatory consumer-protection rights you have under the laws of your country of habitual residence (including, where applicable, the European Union and the United Kingdom).

9. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the State of Qatar, without regard to its conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the Courts of Doha, Qatar for any dispute arising out of or relating to these Terms or your use of the app, except that XenithPulse Software may seek interim or injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

Without prejudice to any mandatory consumer-protection rights you have under the laws of your country of habitual residence (including, where applicable, the European Union and the United Kingdom).

XenithPulse Software operates from Doha, Qatar with an additional operating presence in Doha, Qatar. The choice of Pakistani law and the courts of Lahore reflects the location of primary operations, the production infrastructure, and the founding team. Should the legal entity be re-domiciled in the future, this section will be updated and notified through release notes.

10. Changes to these Terms

We may update these Terms when product behaviour or legal requirements change. Material changes are communicated through release notes, in-app notices, or website updates. Continued use of the app after a change takes effect constitutes acceptance of the updated Terms.
